✦ How it works:

✦ There are no communication or revisions between artist and client after the request is made and while the art is being worked on, please keep this in mind when placing your request.✦ For the minimum price you'll get something smaller like a less rendered headshot/bust, if you wish for a bigger/more complex piece you can pay more.✦ The more you specify and ask for, the more you ought to offer for the piece.✦ If the amount of work to complete your request is worth the price you offer, it will be accepted.✦ If you want, you can leave it up to the artist completely, and getting anything the artist feels like drawing.✦ If you wish to use the art commercially, please specify in your request, otherwise it's for personal use only. (Please refer to "usage licenses and commercial rights" in my TOS for more information about the different usage types.)

✧ No refunds are allowed in this commission type.✧ You may only pay AFTER you get confirmation that your request was approved.✧ Sending a request doesn't mean it will be accepted.✧ You can tip after the piece is delivered if you'd like, but that's not required.✧ Deadline: 2 months after payment.✦ Please remember that my TOS applies for this commission type as well!

I. general rules

✦ All commissioned services by SUMi/MiyazuSumire are legally bound by the Terms of Service, which are publicly available and may be referenced if needed.✦ Clients are responsible for providing clear visual references and written descriptions for the commission.✦ Clients must be 18 years or older to commission me.✦ I strictly prohibit requests that incite hate, discrimination, harassment or illegal activities, as well as usage of commissioned work for such purposes.✦ All commission related communication should be done in writing via email or direct messages.✦ Clients must credit SUMi/MiyazuSumire when using the commissioned work in any form.✦ All my commissions include personal and monetised content usage licenses*.✦ I have the right to decline and refund any commission or request, at any time, for any reason.✦ Usage of the commission or any of my artworks, designs and animations for any blockchain-related technology, including NFTs and cryptocurrency, as well as any AI-related technology, including AI image/art generators and AI learning/training, is strictly prohibited.✦ I will not do gore or NSFW related content of characters that are minors or look like minors.✦ Commissions that require me to replicate other artist's style may be declined at my discretion.✦ I have the right to share and/or stream my work in any format or platform. Any request intended to remain confidential must be clearly communicated by the client in advance.✦ Client is not allowed to distribute the deliverable file(s) “as-is” without my permission.✦ I cannot be held legally responsible for any misunderstandings or misconceptions if the client fails to thoroughly read my Terms of Service.✦ I always reserve the rights to my art. Buying my art does not give you ownership over it.

ii. for character design commissions

✦ Client must provide detailed mood boards, references and written descriptions in the request form. I cannot do the commission without them.
✦ No AI-generated models or elements from existing IPs will be accepted.

iii. for animation commissions

✦ The deadline estimates may vary a lot for each project; the longer the animation is, the longer it will take for me to finish it. The deadline estimate will be informed once the request is accepted.✦ Commissions that require me to replicate pre-existing animations and style will be considered for non-monetised content only, however they may be declined at my discretion.

iv. for surprise me "skeb" commissions

✦ This commission type has no communication or revisions.✦ For the minimum price you'll get something smaller and less detailed, if you wish for a bigger/ more complex piece you may pay more.✦ No refunds are allowed in this commission type.Please refer to Surprise Me Comms for more detailed information.

v. COPYRIGHT AND REPRODUCTION

✦ Clients are permitted to post and use the commissioned work on social media platforms and for monetised content, such as streaming and monetised youtube videos.✦ Other usages, such as merchandise and other commercial licences, must be agreed upon between client and artist prior to usage, and only put in action after fees are fully paid.THE ARTIST RESERVES THE RIGHT TO:✦ Publish the work online.
✦ Claim the commissioned artwork as their own.
✦ Include the commissioned work in their portfolio, commission sheets, etc.THE CLIENT MAY NOT:✦ Claim or copyright the work as their own.
✦ Modify or trace the art.
✦ Reproduce the work for merchandise or commercial purposes without prior agreement or consent from the artist.
✦ Use the commission for any blockchain-related technology, including non-fungible tokens (NFTs) and cryptocurrency or future inventions in the space.
✦ Use the commission for any AI-related technology, including training, validating or testing any neural network or artificial intelligence.
✦ Use the work to incite hate, discrimination, harassment or illegal activities.

vi. revisions

✦ Up to 4 revisions - should be done before sketch colour approval, after that only MINOR changes can be made.
✦ Major revisions will be charged according to the complexity and/or time taken to complete them.
✦ I am not obligated to provide any details that are missing or incomplete due to the client's miscommunication.

vii. payment

✦ All payments are done via Stripe or Ko-Fi. PayPal is only available on VGen requests.✦ You may only pay AFTER you get confirmation that your request was approved.✦ Clients are not authorized to issue a full chargeback for any reason.✦ Priority/rush and complexity fees will apply to requests that demands them.✦ Requests under £1000: Full payment upfront.✦ Requests over £1000: Client may choose between full payment upfront, 50% upfront and 50% once I finish the piece, or opt for a payment plan. This must be agreed between client and artist before first payment is made.✦ I will only start your commission after I receive the payment, full or partial, depending on what's agreed prior.✦ I will only send the final work after receiving the full payment.

viii. usage licenses and commercial rights

Work considered as commercial is anything used for monetary gain or for promotion.

✦ Please respect the terms of each usage license, if the client wishes to use commissioned work for specific purposes, such as merchandise and other commercial use, the client must communicate it clearly in advance and pay any fees that apply.✦ All my commissions include personal and monetised content usage licenses.PERSONAL USE:✦ Individual, non-monetised, non-commercial only.
✦ Personal use refers to the use of artwork solely for private, non-commercial purposes, meaning the client does not profit from the artwork or use it in any business related context.Examples of acceptable personal use include: Posting the commissioned work on social media, using as a profile picture or banner, using as desktop background.COMMERCIAL USE:✦ Commercial use refers to the use of artwork for profit-generating purposes in a business or commercial context.Commercial use will be further separated into 3 categories: Monetised Content, Merchandise and Brand Collaboration/Company Work.MONETISED CONTENT USE:✦ Individual or businesses, monetised.
✦ Monetised content use refers to the use of artwork by content creators and/or legal entity (company) for profit-generating purposes as part of creating and distributing monetised digital content.
✦ Artwork licensed for monetised content use may be utilized as livestream assets, monetized videos, or other revenue-generating content.
✦ Content usage license does not include the right to distribute digital goods in paywalled platforms such as Patreon or as membership rewards.Examples of acceptable monetised content use include: Using as livestream assets, monetized videos.MERCHANDISE USE✦ Individual or businesses, monetised, commercial.
✦ Merchandise use license the only one that grants the client the legal right to use the artwork on digital or physical products (merchandise) intended for sale, distribution, or other profit-generating purposes.
✦ Merchandise license also extends to digital goods distributed online for profit, such as content provided through paywalled platforms like Patreon or as membership rewards.
✦ Additional charges apply to any commissioned work intended for merchandising.Examples of acceptable merchandise use include: Creating and selling merch items like stickers and prints, distributing as Patreon reward.BRAND COLLABORATION & COMPANY WORK✦ Individual or businesses, monetised, commercial.
✦ Brand collaboration and company work license refers to the usage of the artwork for promoting a company or business in any way.
✦ This license is intended only for individuals representing a company or agency (such as corpo vtubers), content creators that want to use the commission for making content in collaboration with brands (example: ads) and businesses/companies.
✦ Additional charges apply to any commissioned work intended for companies and brand collaborations.Examples of acceptable brand collaboration & company work use include: Any work that's used by corpo vtubers, businesses and companies in any way, using for advertisements in collaboration with brands.

ix. privacy fees

✦ Any request intended to remain confidential must be clearly communicated by the client in advance.✦ Client must let me know on their request if they want me to refrain from streaming or posting WIPs of the artwork.✦ NDA fee: +50% of total commission price.✦ NDA is only applicable if both artist and client agreed to it and the fee has been paid.✦ After the client posts or uses the commissioned work I am allowed to post it on my own social media as well as include it in my portfolio, commission sheets, etc.

x. refunds and chargebacks

✦ If you cancel your order, or vice versa, you will get a full refund only if I have not started your piece yet.✦ Clients may only be eligible for a 50% refund if a valid reason is provided and accepted.✦ Once the line + colour is approved, I do not allow refunds. For animations: once rough animation is approved.✦ It is strongly advised that commissioners are fully committed before placing a request to avoid complications, including potential fees associated with refunds by Stripe and PayPal.✦ Filing a chargeback will result in forfeiture of all rights to commissioned work. Additionally, you will be added to my blacklist, barred from future purchases and requests.

xi. timeline and work schedule

✦ Once your request is approved, you will be contacted for further discussion and payment information.✦ I will start working on the commission after upfront payment has been made, according to priority order.✦ The general timeline for each project is 1-3 months, unless otherwise stated.✦ The timeline for animations may vary a lot for each project, starting at 3-6 months; the longer the animation is, the longer it will take for me to finish it. The timeline estimate will be informed once the request is accepted.✦ Processing time may be extended if client requires multiple revisions and/or submits multiple commission requests at the same time.✦ If the client needs the artwork done within a certain deadline, they must inform me through the commission form.✦ A rush or priority fee may be applied depending on how soon the client wants the commission done.
